federal law grants more rights to citizens, therefore federal law supercedes state. However if the state law grants more rights or a plethora of other small reasons which include federal law constitutionality, state law wins. In the case of third brake lights, some states dont require it, so you dont need it (more right). However, a good case for any lawyer to bring forth in a rear end collision involving injury would be to bring up a LACK of a FEDERALLY mandated safety feature that the driver PURPOSELY took off.
